In the Azerbaijan Republic same-sex acts between both men and women are illegal under Article 113 (3 Years) of a recently introduced based criminal code, with penalties including whipping and execution. Azerbaijan still has statutes that ban same-sex acts between men. However there appears to be no clear commitment by the government of Azerbaijan to decriminalisation.

The legal situation for gays here is more liberalised that in the Central Asia, but not as much as in Europe. The battle here is over Government and police. It is very hypocritical that 90% of the men have had a same-sex relationship yet still want it to be illegal.
